The most common torts of law are those pertaining to nuisances, statutory, economics, negligence and intentional actions. Injury cases are predicated on being able to prove that someone or an organization operated in a negligent way or that they operated in such a fashion that is considered outside societal expectations. Four things are necessary for a judge or jury to return a positive ruling.
- It is a consideration that the accused had some obligation or a duty to the plaintiff like opeating one’s car in a safe manner. Another example would be for a business to provide a hazard free place for occupants and guests.
- It must be clear that some sort of responsibility was not carried out and thus “overlooked” in one way or another. In the example of driving in a safe manner, the prosecution must necessarily prove that the vehicle was not driven in a safe manner such as driving beyond the posted speed limit and thus endangering the plaintiff.
- It must also be proved that an injury did occur. Most people assume this means damage to personal health or life. These are physical injuries. As a legal description, those things that are not tangible can also be included. These may include some type of a financial loss, loss of potential income and emotional loss such as mental anguish and suffering,
- The last item for the prosecution to prove is that the actions or ommissions by the accused actually caused an injury to occur. Cause and effect must be present.
If all of these requirements are present then a personal injury lawsuit may be brought into a court of tort law. Your Scottsdale personal injury lawyer will be happy to determine if you have a case.
